Terms of Service

All photography, videography, digital assets, creative materials, marketing content, edits, renderings, and related deliverables (collectively, the “Media”) delivered by The Forty Company (“Company”), a Subsidiary of Hedgerock Corp., headquartered at 15 Frowein Road, Center Moriches, New York 11934, are provided subject to the following terms and conditions. Upon delivery, receipt, access, or use of the Media, the receiving party (“Recipient”) shall be deemed granted a non-exclusive, worldwide, perpetual, irrevocable, transferable, and sublicensable right and license to use, reproduce, publish, distribute, display, transmit, modify, adapt, market, advertise, syndicate, and otherwise exploit the Media, in whole or in part, across any and all mediums, formats, platforms, publications, or technologies now known or hereafter developed (including, without limitation, digital, print, social media, editorial, broadcast, commercial, and promotional applications).

Recipient shall retain sole discretion with respect to publication, distribution, placement, modification, and usage of the Media, and no additional approval, consent, review, or authorization from the Company shall be required following delivery. Attribution, watermarking, production credit, tagging, authorship acknowledgment, or any similar form of recognition to the Company, Hedgerock Corp., or any affiliated entity or representative shall not be required, and the omission thereof shall not constitute a breach of any agreement or obligation.

The Media is provided on an “AS IS” basis, without representations or warranties of any kind (express or implied), and the Company expressly disclaims any liability arising from or related to the publication, modification, distribution, or use of the Media by Recipient or any third party. These Terms shall be governed by and construed in accordance with the laws of the State of New York.
